TERMS AND CONDITIONS OF USE OF THE WEBSITE AND SERVICES

IMPORTANT LEGAL NOTICE: By accessing this website, providing personal information, scheduling consultations, making payments or using any of our services, you expressly, freely and informed accept all of these Terms and Conditions. 1. COMPANY INFORMATION AND SCOPE OF SERVICES

MEX-USA Legal Services LLC is a binational legal services company incorporated under the laws of the State of California, United States of America, with its registered office at 3520 Long Beach Blvd, Suite 218, Long Beach, California 90807.

1.1 Services Offered

Our documentary and legal assistance services may include, but are not limited to:

• Mexican dual nationality procedures

• Correction and amendment of Mexican and US birth certificates

• Apostilles under the Hague Convention (1961)

• Certified and sworn translations (Spanish-English)

• Powers of Attorney and Notarized Documents in California

• Notary Services Certified by the State of California

• Binational legal and documentary consulting

• Coordination with lawyers and legal professionals in Mexico

• Legal research and coordination of cross-border cases

• Legal representation and assistance in Mexico through affiliated lawyers or duly accredited third parties

2. LIMITATIONS ON LEGAL PRACTICE IN THE UNITED STATES

MEX-USA Legal Services LLC is NOT a U.S. law firm and is not authorized to practice law before the courts of the United States of America. It is expressly stated that:

• We do not represent clients before federal or state courts, tribunals, or agencies in the United States.

• We are not representatives, agents, or affiliates of any U.S. government agency with authority over immigration, citizenship, or any other immigration matter.

• We do not provide legal advice, legal advice, or assistance of any kind with respect to U.S. immigration law, criminal law, employment law, or any other area of U.S. law.

• Our services are limited to documentary procedures, notary public and coordination with legal professionals in Mexico.

WARNING: If you require legal advice regarding immigration or other matters of U.S. law, you should consult an attorney who is duly licensed in the State of California or the appropriate state.

3. PERSONAL DATA PROTECTION AND DIGITAL PRIVACY

The processing of your personal data is governed by the regulations applicable in both jurisdictions:

3.1 Applicable Legal Framework

• California Consumer Privacy Act (CCPA) — Cal. Civ. Code § 1798.100 et seq.

• California Privacy Rights Act (CPRA) — effective January 2023

• Federal Law on the Protection of Personal Data in Possession of Private Parties (LFPDPPP) — Mexico

• LFPDPPP Regulations and INAI Guidelines

3.2 Data We Collect

We may collect, process and store the following personal data:

• Identification data: full name, date of birth, CURP, passport number, official identification number

• Contact details: address, email, telephone number

• Documentary data: birth certificates, marriage, death, official IDs, immigration documents

• Browsing data: IP address, browser type, pages visited, cookies and similar technologies

• Financial data: information needed to process payments (we do not store full credit/debit card data)

3.3 Purpose of Data Processing

Your personal data will be used exclusively for:

• Provision of contracted services

• Communication on the status of your procedure

• Compliance with legal and regulatory obligations

• Improving our digital services

• Invoicing and collection management

3.4 ARCO Rights (Access, Rectification, Cancellation and Opposition)

Under the Mexican LFPDPPP, you have the right to:

• ACCESS: To know what personal data we have about you

• RECTIFICATION: Correcting inaccurate or incomplete data

• CANCELLATION: Request the deletion of your data when applicable

• OPPOSITION: Object to the processing of your data for specific purposes

3.5 Rights under CCPA/CPRA (California Residents)

California residents have the right to:

• Know what personal information we collect, use, or disclose

• Request deletion of your personal information

• Not to be discriminated against for exercising your privacy rights

• Correct inaccurate personal information

4. CYBER SECURITY AND INFORMATION PROTECTION

4.1 Security Measures Implemented

MEX-USA Legal Services LLC implements reasonable technical, administrative, and physical measures to protect your personal information, including:

• SSL/TLS encryption on all website communications (HTTPS)

• Credential access control and two-factor authentication (2FA) for internal systems

• Secure document storage with restricted access

• Internal policies for handling and destroying confidential documents

• Regular training of staff in cybersecurity and data handling

4.2 Transmission of Documents

By submitting documents to us by electronic means (email, WhatsApp, web forms, or other digital platforms), you acknowledge that:

• The transmission of data over the internet carries inherent risks that we cannot guarantee in their entirety

• It is your responsibility to use secure devices and networks when sending sensitive information

• We recommend not sending physical original documents by mail without prior confirmation

4.3 Notification of Security Breaches

In the event of a security breach that compromises your personal data, we will proceed in accordance with:

• California Data Breach Notification Law (Cal. Civ. Code § 1798.29 and § 1798.82): Legally Established Notice

• LFPDPPP Mexico, Art. 20: notification to the affected owner and the INAI when applicable.

5. USE OF THE WEBSITE AND COOKIES

5.1 Cookie Policy

Our website may use cookies and similar technologies to:

• Ensure the technical operation of the site

• Analyze visitor traffic and behavior (analytics)

5.2 Permitted Use of the Website

5.3 Intellectual Property

All content on this website, including text, logos, images, graphic design, and informational materials, is the exclusive property of MEX-USA Legal Services LLC or its licensors, and is protected by California and Mexican intellectual property laws. Their reproduction, distribution or use without express written authorization is prohibited.

6. PAYMENTS, FEES, AND REFUND POLICY

6.1 Payment Structure

• Some services require the payment of an advance deposit or staged payments under the service contract.

• Consultations are paid services, unless otherwise indicated in writing.

• Final documents prepared or managed may be retained until the total balance is covered.

• Online payments are processed through secure PCI-DSS certified payment platforms. We do not store complete bank card data.

6.2 Refund Policy

Eligibility for reimbursement will be determined by the nature and stage of advancement of the service:

• Inquiries made, work already performed, government payments (consular fees, registration fees), translations completed, and third-party costs already incurred are NON-refundable.

• Retention contract: once signed, the customer has 24 hours to cancel it free of charge. After this period, we reserve the right to charge the fees accrued proportionate to the work performed.

• Special cases: Any refund request outside of these cases will be assessed individually and notified in writing within 10-20 business days.

7. NO GUARANTEE OF RESULTS

MEX-USA Legal Services LLC does not guarantee approval of any procedure, obtaining specific documents, determined resolution times, or favorable results in any administrative or judicial proceeding.

Each case depends on legal, administrative, and individual circumstances beyond our control, including the accuracy and completeness of the information provided by the client.

The customer is responsible for the truthfulness, accuracy and authenticity of all documentation and information provided. MEX-USA Legal Services LLC will not be liable for any delays, rejections, or consequences arising from false, incomplete, or apocryphal information.

8. GOVERNMENT DELAYS AND FORCE MAJEURE

We do not assume responsibility for delays, refusals or errors caused by:

• Courts, tribunals and tribunals in Mexico and/or authorities in the United States

• Mexican or U.S. consulates and embassies

• Civil registries, notaries' offices and government agencies

• Ministry of Foreign Affairs (SRE), SEGOB, RENAPO

• Courier and parcel services

• Strikes, work stoppages, health contingencies, natural disasters or any case of force majeure

• Changes in government regulations, laws, or procedures

9. ELECTRONIC COMMUNICATIONS

By hiring us, you expressly agree:

• Receive communications via email, SMS, WhatsApp, and other electronic messaging platforms

• The use of digital and electronic signatures with full legal validity when the applicable regulations allow it

• That communications via e-mail to the address on file constitute valid notice

It is the customer's responsibility to keep their contact information up to date. MEX-USA Legal Services LLC will not be responsible for notices not received due to incorrect or outdated contact information.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

• MEX-USA Legal Services LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any nature.

• We will also not be liable for losses arising from adverse government decisions, refusals of paperwork or incomplete information provided by the customer.

• In no event shall our total liability to the customer exceed the total amount actually paid for the specific service in question.

• This limitation applies regardless of the legal theory under which it is claimed (contract, tort, negligence, or other).

11. INDEMNIFICATION

Customer agrees to indemnify, defend, and hold harmless MEX-USA Legal Services LLC, its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of: (a) the use of the Website or Services; (b) violation of these Terms and Conditions; or (c) the provision of false, incomplete or misleading information.

12. RELATIONSHIP WITH AFFILIATED ATTORNEYS, SUPPLIERS, AND THIRD PARTIES

MEX-USA Legal Services LLC acts as the main company and the only interlocutor responsible to the client in all contracted services. For the execution of these services, we may coordinate with two types of external collaborators: (a) lawyers and professionals affiliated with our network, with whom we maintain a supervised provider relationship; and (b) independent third parties such as notaries, law firms, certified translators or other specialists, hired according to the specific needs of each case. In both cases, MEX-USA Legal Services LLC is directly responsible to the client for the correct coordination and result of the service.

• MEX-USA Legal Services LLC is directly responsible to the client, regardless of whether the service is performed by internal personnel, an affiliate of our network, or a third party hired for the specific case.

• Affiliated attorneys and professionals are part of our network of supervised providers and operate under the standards of quality and confidentiality that MEX-USA Legal Services LLC establishes.

• Independent third parties (notaries, translators, external firms, etc.) are hired by MEX-USA Legal Services LLC on behalf of the client and under our coordination and supervision.

• When the client expressly designates his or her own attorney or legal representative to intervene in the case, MEX-USA Legal Services LLC may coordinate with such professional in the capacity of facilitator and document liaison. In this case, responsibility for the legal strategy, deadlines, and results of the case will fall on the client's designated attorney, and MEX-USA Legal Services LLC will limit its participation to the documentary and coordination efforts expressly agreed upon in writing.

• All suppliers and third parties are subject to confidentiality and personal data protection agreements with MEX-USA Legal Services LLC.

• Customer shall not make direct payments to any affiliate, vendor, or third party without prior written authorization from MEX-USA Legal Services LLC. Unauthorized payments do not create any obligation for this company.

• In the event of any default, delay or deficiency attributable to a supplier or third party, the customer must notify MEX-USA Legal Services LLC, who will manage the solution directly.

• Fees from suppliers and third parties are included in the total quote provided to the client, unless otherwise expressly stated in writing in the applicable service contract.

13. DISPUTE RESOLUTION

13.1 Direct Negotiation

In the event of any dispute arising from these Terms and Conditions, the parties undertake to first attempt an amicable resolution through direct negotiation within 30 calendar days.

13.2 Mediation

If direct negotiation is unsuccessful, the parties may submit the dispute to mediation before a mutually agreed neutral mediator.

13.3 Arbitration and Jurisdiction

• For matters relating to services rendered in or for California: The courts of Los Angeles County, California, shall have exclusive jurisdiction.

• For matters related to services in Mexico: Mexican laws and the jurisdiction of the competent courts in Mexico will apply.

• The client expressly waives any other jurisdiction that may correspond to him by reason of his present or future domicile.

14. GOVERNING LAW

These Terms and Conditions are governed by, construed and enforced in accordance with:

• The laws of the State of California, United States of America

• The applicable federal laws of the United States of America

• The federal and state legislation of Mexico as it pertains to services rendered in that territory

In the event of a conflict between the two legal systems, the parties shall agree in good faith on the applicable regulations according to the nature of the service in question.

15. MODIFICATIONS TO THESE TERMS AND CONDITIONS

MEX-USA Legal Services LLC reserves the right to modify, update, or replace these Terms and Conditions at any time. Changes will be effective upon posting on the website. The user is encouraged to periodically review this section. Your continued use of the Website or our Services after modifications are posted will constitute acceptance of the new terms.

16. SEPARABILITY

If any provision of these Terms and Conditions is declared null, invalid or unenforceable by a competent authority, such declaration shall not affect the validity or enforceability of the remaining provisions, which shall continue in force and effect.

17. ENTIRE AGREEMENT

These Terms and Conditions, together with the Privacy Policy and any contracts for the provision of services entered into, constitute the entire agreement between the parties regarding the use of the website and the provision of services, and supersede any prior oral or written agreements on the same subject matter.
